I applied to rent a co-op apartment in Manhattan and, as part of the board application package, both the owner and I signed a REBNY co-op sublease agreement. My application is still pending — according to the application portal, the package just has been submitted to the board, and I haven’t had or scheduled a board interview.
While waiting, I’ve continued looking at other apartments because the owner initially told me there was another application in progress and specifically encouraged me not to forego other opportunities. The process has taken longer than expected, and I’m now trying to understand what my options would be if I decided to pursue another apartment.
The part I’m confused about is the distinction between the signed sublease being effective and the tenancy actually commencing. The agreement says the “Sublease Effective Date” is when a fully executed copy is returned to the subtenant, but it also says the sublease may not commence and I cannot occupy the apartment until the co-op board approves me.
So my questions are:
I’m looking to speak with a NY attorney as well, but would love to hear from anyone who has dealt with this situation or is familiar with NYC co-op rentals (or had attorney recs that won’t break the bank!) thanks all!
